No Damages Needed For FCRA Claim

A plaintiff applied for an emergency medical technician job and alleged that the employer’s background check violated the Fair Credit Reporting Act (FCRA). The court concluded that the plaintiff could sue, as the FCRA allows for claims even without injuries, emphasizing the employer’s liability for willful violations. The court allowed the plaintiff to proceed with the claims.

 

WHY THIS IS IMPORTANT... The FCRA does not require a showing of damages to maintain a claim. Even though this person did not allege that they were injured because they alleged that the employer willfully violated the FCRA, they were entitled to sue.
