MANSPLAINING DOES NOT CREATE CASE

The 1st U.S. Circuit Court of Appeals ruled that an employee could not claim a hostile work environment based solely on allegations of “mansplaining” by a male colleague. The court found that her claims did not demonstrate pervasive harassment based on gender.

 

WHY THIS IS IMPORTANT… The court noted that the incidents lacked a clear connection to gender discrimination. General disagreeable behavior is not enough for a Title VII claim.
