Family members who are partners in a series of businesses are involved in a dispute over who was required to pay real estate taxes on the property. Some of the contracts called for arbitration. Others did not. After an arbitration was filed, one of the partners went to court and succeeded in stopping parts of the arbitration.
WHY THIS IS IMPORTANT… Arbitration is a creature of contract. Where there are multiple contracts, all of them must have an arbitration clause. If not, you end up in the worst of both worlds – two litigations on different timetables for the same dispute.
