CIPA Claims Dismissed for Lack of Standing

Recent court decisions regarding the California Invasion of Privacy Act (CIPA) have dismissed lawsuits due to a lack of standing. Courts now require plaintiffs to demonstrate concrete harm, shifting away from the notion that a mere statutory violation is adequate. This trend may restrict future CIPA claims and give companies more grounds to dismiss unfounded allegations.

 

WHY THIS IS IMPORTANT… there is a growing uncertainty in privacy litigation. Many jurisdictions require that actual damages be proven, reducing the number of cases filed. In other areas, legislatures are drafting statutes that explicitly do not require damages to be proven to collect statutory damages and attorney fees. This field will evolve over the next few years, creating uncertainty.
