The plaintiff challenged a $20 fee imposed when he paid off his mortgage. The court found this fee unauthorized, stating it was not permitted under the mortgage terms or applicable law. Consequently, the plaintiff was awarded nominal damages and reasonable attorney’s fees.

 

WHY THIS IS IMPORTANT… This case was brought under the Unfair and Deceptive Trade Practices Act, known for triple damages. However, these cases can also be pursued even when no damages exist. In those instances, the prevailing party is awarded attorney fees, which can still amount to a significant sum.
